Safeguarding from abuse and improper treatment

A legal requirement to protect people from abuse and improper treatment, with systems that are set up and run effectively to prevent abuse.

What the regulations expect

For providers registered with CQC in England, Regulation 13 of the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014 says people who use services must be protected from abuse and improper treatment.

It requires systems and processes to be established and operated effectively to prevent abuse.

How I approach it

  1. Finding

    A gap in safeguarding systems, records or staff understanding is found.

  2. Action

    Policies, recording and escalation are strengthened.

  3. Evidence

    Audit shows safeguarding practice is consistently followed.

  4. Sign-off

    The actions are reviewed and signed off.

  5. Sustained improvement

    The learning is built back into everyday practice.

What do you look at in safeguarding?

Safeguarding governance, policies and procedures, staff understanding, recording and documentation, audit and assurance, escalation processes, and learning and improvement.

Is safeguarding assurance different from having a safeguarding policy?

Yes. A policy sets out what should happen. Assurance is being able to show that safeguarding practice is consistently embedded, through staff understanding, records, audit and learning.

Do you look at how concerns are recorded and escalated?

Yes. Recording and documentation and escalation processes are both part of the review, alongside staff understanding.
